Mobile Communications Terms of Service

These Mobile Communications Terms of Service ("Mobile Terms") govern phone calls, SMS/text messages, and other mobile communications between Miner Strong LLC ("Miner Strong," "we," "us," or "our") and you. By providing your phone number, initiating contact with us via phone or text, or selecting a preferred communication method on any Miner Strong form, you agree to these Mobile Terms.

These Mobile Terms work in conjunction with our Terms of Service, Custom Order Terms of Service, and Privacy Policy. We respect your right to privacy. To see how we collect and use your personal information, please see our Privacy Policy.

We may modify these Mobile Terms at any time. Your continued use of our mobile communications following any modification constitutes your acceptance of the modified Mobile Terms.


1. Non-Promotional Communications

We may contact you via manual (non-autodialed) phone calls or SMS/text messages to:

  • Respond to your inquiries, form submissions, or custom order quote requests;

  • Return your calls or texts;

  • Coordinate order details, design proofs, shipping, or customer support;

  • Communicate based on your indicated preferred communication methods (e.g., "call" or "text" selected in our forms).

These communications are non-promotional and directly related to your interactions with us.

2. Consent for Calls and Texts

By providing your phone number, selecting a preferred communication method on our forms, submitting an inquiry, or initiating contact with us via phone or text, you provide prior express consent for Miner Strong to contact you via manual (non-autodialed) phone calls or SMS/text messages about your specific request, order, or interaction.

Consent to phone or text contact is not a condition of any purchase or use of our services. Your participation in phone or text communications is entirely voluntary.

3. Message and Data Rates

Standard message and data rates from your wireless provider may apply to any calls or text messages. Frequency of calls and messages varies based on your interaction with us. Miner Strong is not responsible for carrier charges. Check your mobile plan and contact your wireless provider for details.

4. Opt-Out

You may opt out of receiving calls or texts from Miner Strong at any time:

  • Text opt-out: Reply STOP to any text message from a Miner Strong-associated number. You will receive a one-time opt-out confirmation text. No further texts will be sent unless you re-initiate contact.

  • Call opt-out: Verbally request during a call to stop future communications, or email info@minerstrong.com with your request.

Opt-out requests will be honored within 10 business days as required by federal law. Opting out of phone or text communications does not affect email communications regarding your active orders or inquiries.

If you have multiple communication programs with us, you may need to opt out separately for each.

5. Support and HELP

For assistance with our mobile communications, text HELP to any Miner Strong-associated number, or contact us at info@minerstrong.com. Customer support is available during regular business hours.

6. Data Protection and Third-Party Sharing

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services (such as messaging aggregators solely for the purpose of delivering messages you have consented to receive) is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We maintain timestamped records of all opt-in and opt-out actions to comply with the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles, and applicable state and federal laws.

7. SMS Marketing

Miner Strong does not currently operate a promotional SMS marketing program. If we introduce SMS marketing in the future, it will be opt-in only and governed by separate consent language disclosed at the point of opt-in. You will not receive promotional or marketing text messages from us without your express, opt-in consent.

If you have opted in to any Miner Strong promotional communications through our marketing subscription channels, those communications are governed by the terms disclosed at the point of opt-in. You may opt out of marketing communications separately by following the opt-out instructions provided in those messages.

8. Program Description

Miner Strong's mobile communications program sends messages to customers who have interacted with us through our custom order quote request form, general contact channels, or by initiating contact with Miner Strong via phone or text. Messages may include quote responses, order updates, design proof coordination, shipping details, and customer support communications.

Opt-in is collected via web forms with communication preference checkboxes or through your initiation of contact with us via phone or text. Message frequency varies based on the nature of your interaction with us.

9. Carrier Information

Our SMS communications work with all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, and most regional carriers. Wireless carriers are not liable for delayed or undelivered messages. Miner Strong is not liable for any failed, delayed, or misdirected delivery of any communication.

10. Age Restriction

You must be 18 years or older to receive mobile communications from Miner Strong. By providing your phone number or engaging in mobile communications with us, you represent and warrant that you are at least 18 years of age.

11. Changes to Phone Numbers

We may change any phone number we use to send messages at any time and will notify you where practicable. You acknowledge that any messages, including STOP or HELP requests, you send to a phone number we have changed may not be received, and we will not be responsible for honoring requests made to inactive numbers.

You agree to provide us with a valid mobile number. If you obtain a new mobile number, you must inform us or re-initiate contact from your new number.

12. Compliance

Miner Strong complies with all applicable laws and regulations regarding SMS and phone communications, including the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles and Best Practices, and applicable state laws.

13. Limitation of Liability

To the fullest extent permitted by applicable law, you agree that Miner Strong will not be liable for failed, delayed, or misdirected delivery of any information sent through our mobile communications, any errors in such information, or any action you may or may not take in reliance on the information or communications.

14. Governing Law

These Mobile Terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Any disputes arising from or related to these Mobile Terms shall be brought exclusively in the state or federal courts located in Roanoke County, Virginia.
